By Andrew M. Cohen, Esq, GM of EMC eDiscovery reveals the Ten eDiscovery Commandments:

The 1st Commandment:
Thou shalt exhibit competence and avoid pleading technological ignorance

The 2nd Commandment:
Thou shalt cooperate and be transparent

The 3rd Commandment:

Thou shalt comply with the “duty of preserve evidence”

The 4th Commandment:
Thou shalt take meet and confer conferences seriously

The 5th Commandment:
Thou shalt educate thyself (and thine outside counsel) as to thine systems and what is & is not feasible

The 6th Commandment:
Thou shalt not misrepresent thine systems capabilities or lack thereof

The 7th Commandment:
Thou shalt identify “inaccessible” data sources during discovery

The 8th Commandment:
Thou shalt cooperate with counsel to conduct search terms

The 9th Commandment:
Thou shalt remember Rules ! and 26(g) regarding cost/proportionality

The 10th Commandment:
Thou shalt be wary of eDiscovery sanctions if these commandments are ignored (see above 9 commandments)
